    Marc Elias has just put together the most insightful and comprehensive description of it. I skip 2:39 into it to bypass the intro and get right to the meat. PLEASE watch at least a few minutes of it. He’s credible, and has been effective at arguing cases to SCOTUS, and winning.

    IMO, this is the most epic presentation I’ve seen from him to date, and they’ve all been good.

    I’m still learning on the fly. My newest question is about how or whether or not it’s even possible to fight this, and federal actions like seizing ballots or voter rolls/databases from states. Marc Elias would be the expert here. In fact, redistricting inacted by any political party should, it seems to me, to be an illegal disenfranchisement of opposing party voter rights. It is a legislative action that intentionally removes the power of the other party’s votes, right?

    Just answering one question with another here. While I’m pretty sure answers will come from Elias, Newsom, and the few competent others who are on top of the issues right now. (I think Brian Taylor Cohen (BTC) is a pretty competent law student.)

    I  find it disturbing how far individual officials are willing to stretch legal authority. The cynic in me says “This is part of “MAGA mission creep” for a third term. But the crux of it will be where the situation becomes less about grand schemes and more about how systems behave under pressure. So I think the courts will hold solid.

    Agree with Reg. Not a 4th amendment constitutional issue requiring probable cause. Bill of rights is about protecting individual citizens in their freedom, liberty etc. from government overreach. Not sure there is even precedent for this sort of thing. Seizing ballots? Not just seizing ballots but doing it in a systematic way in an attempt to defeat our system of government.

    Although it is interesting that Citizens United extended first amendment rights to corporations. And if this is an issue of first impression then perhaps the ‘penumbras’ cover this action. Although with this court i doubt it.

    Whatever happens agree with the speakers in vid. that the democrats need to be proactive. They could try for a declaratory judgment or just take this shit to court claiming whatever infringement of rights. If the plaintiffs lose then the Supreme Court ought to take the case sua sponte. Or perhaps on a writ of certiorari. Talk about significant legal issues that need resolution right quick!

    Which court could issue a declaratory judgment on issues of rights that the rest of the government would be bound to respect?

    And if declaratory judgments from courts could recognize or restore rights, why weren’t declaratory judgements used to abolish slavery and Jim Crow, establish gender equality, declare children to be human beings, invalidate “crime against nature” and Sodomy laws and recognize same-sex marriage, or address any number of other injustices?

    I wish it were that simple.
