I stand by what i said regarding the utility of declaratory judgments. I could add to what i said but i will leave it as is.
The ideal scenario is to have SCOTUS lay down the law of the land. Declaratory judgment might be or could be part of chain of causation that lands us there.

Agree with Reg. Not a 4th amendment constitutional issue requiring probable cause. Bill of rights is about protecting individual citizens in their freedom, liberty etc. from government overreach. I find it disturbing how far individual officials are willing to stretch legal authority. The cynic in me says “This is part of “MAGA mission creep” for a third term. But the crux of it will be where the situation becomes less about grand schemes and more about how systems behave under pressure. So I think the courts will hold solid.

Politics 2 months, 1 week agoI don’t know any of the law concerning presidential pardons but the notion that a pardon eliminates the duty of restitution does not make sense to me. The victims have constitutional rights and that is at a minimum an unjust taking.
